These terms apply to the Range Freely apps you download from the App Store ("the apps") and to rangefreely.app. They add to Apple's standard Licensed Application End User License Agreement (the "Apple EULA"), which governs your licence to the app. If these terms and the Apple EULA conflict on something the Apple EULA covers, the Apple EULA wins. The apps are not directed at children under 13.
The apps are training and general-wellness tools. They are not medical devices. They do not diagnose, treat, cure, prevent or screen for any disease or condition, they do not detect arrhythmias or heart attacks, and nothing they show is a medical assessment or a medical decision aid. What an app shows cannot tell you whether you need care. If you think you may be having a medical emergency, call your local emergency number. See also Not a medical device.
Measures such as DFA α1 come from published exercise-physiology research and are shown as research-stage indicators. They are valid only under certain conditions (steady exercise once warmed up, a clean signal) and some people's hearts do not produce the pattern they assume. The apps tell you when a reading is withheld or provisional. A reading is information for your own training, not a measurement of your health. See About DFA α1.
You are responsible for how you exercise and for using your equipment properly. Exercise carries risk. The apps do not monitor you for safety and cannot alert anyone if something goes wrong.
Some features are free. An optional yearly subscription, bought through the App Store, unlocks further features. Prices are shown in the app and on the App Store in your currency. Apple takes the payment and manages renewals, cancellation, refunds and Family Sharing under its own rules. The subscription renews automatically each year until you cancel it at least 24 hours before the end of the current period in your Apple Account settings. "Restore Purchases" in Settings brings back a subscription you already paid for. We do not receive your payment details.
Your recordings stay on your device. You own them, including anything you export. We do not receive them. How the apps handle information is described on the Privacy page.
The apps, their design, text and software belong to Bluebird Foundry LLC or its licensors. You may use them for your own training. You may not copy, modify, resell or reverse-engineer the apps, or remove notices from them, except as the law allows.
The apps work with chest straps and other equipment made by others (for example Polar). We are not affiliated with those companies and they are not responsible for the apps. Names such as Polar, Apple, Apple Watch and Kubios belong to their owners.
The apps are provided "as is" and "as available". We do not promise that they will be uninterrupted or error-free, that a reading is accurate for your body, or that they suit a particular purpose. Some places do not allow some of these exclusions, so they apply only as far as the law permits.
To the extent the law allows, Bluebird Foundry LLC is not liable for indirect or consequential loss, or for injury or loss arising from how you train or from decisions you make using the apps. Our total liability to you for anything arising from the apps is limited to the amount you paid us for them in the 12 months before the claim, through the App Store. Nothing here limits liability that cannot lawfully be limited.
We may update the apps and these terms. If a change affects you materially we will update the date above and note it in release notes. You can stop using the apps at any time by deleting them. We may stop offering the apps or a feature, and will say so in advance where we reasonably can.
These terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-laws rules, and disputes will be brought in the state or federal courts located in Georgia, unless local consumer law gives you the right to bring them elsewhere.
